Collective Bargaining Agreement for Part-Time Faculty

Memorandum of Understanding (MOU)
Between
Central New Mexico Community College
and the
Central New Mexico Community College Employees Union

WHEREAS, the Central New Mexico Community College and the Central New Mexico Employees Union shall be collectively identified as the “Parties” in this MOU and;

WHEREAS, the Central New Mexico Community College (“College") and the Central New Mexico Employees Union ("Union”) have completed negotiations on a successor Collective Bargaining Agreement (“CBA”) to their current CBA, and;

WHEREAS, the parties agree that the continuation of the course scheduling pool will be as a pilot program, and;

WHEREAS, the Parties agree that experiencing how the Part-time Faculty Scheduling process works, will improve mutual understanding as it relates to that process;   

NOW, THEREFORE, the Parties agree as follows: 

  1. The College will evaluate the feasibility of providing the CNMEU President and the CNMEU Vice President for Part-time Faculty, the opportunity, on a temporary basis, to assume the role fulfilled by Associate Deans during the course scheduling process, for the purpose of assigning courses to part-time faculty in the same way the Associate Deans would in a real world environment.
  2. If feasible, the parties agree to conduct this exercise, on a one time basis, during the 2022 Spring Semester, for the purpose of assigning classes to part-time faculty, in the 2022 Fall Semester, in the School of Math, Science, and Engineering.

WHEREAS, the Central New Mexico Community College and the Central New Mexico Employees Union shall be collectively identified as the “Parties” in this MOU and;

WHEREAS, the Central New Mexico Community College (“College") and the Central New Mexico Employees Union ("Union”), representing Part-time Faculty, have completed negotiations on a successor Collective Bargaining Agreement (“CBA”) to their current CBA, and;

WHEREAS, the Parties recognize part-time faculty are responsible for classroom management responsibilities in addition to time spent while engaged in the direct instruction of students, and;

WHEREAS, the College shall continue to exercise due diligence as it prepares face-to-face (F2F) and distance learning course offerings each term to avoid cancellation of distance learning courses after instructors have prepared course shells and;

WHEREAS, the Parties recognize that course pay for part-time faculty includes time spent on class preparation whether the course is face-to-face or online, that class cancellations are an inherent part of the instructional profession, and that these two principles are inviolate;

WHEREAS, the Parties further recognize the COVID-19 Pandemic and the Parties’ commitment to providing the safest and best possible instructional environment for students has resulted in classroom management responsibilities and class preparation requirements that may differ from what existed prior to the pandemic;

NOW, THEREFORE, the Parties agree as follows:

For the 2022 Spring Semester and 2022 Summer Semester only, a part-time faculty member may receive $270.00 when an assigned class is cancelled after the part-time faculty member has created a new shell, provided that:

a) there was no pre-existing shell that could have been used;

b) the new shell that was created meets the Distance Learning Department’s requirements for future use;

c) the Distance Learning Department has validated and approved the shell as eligible for payment;

d) the appropriate dean or designee has also approved the course shell as eligible for payment;

e) the parties affirmatively acknowledge that this concession cannot and will not be viewed as a precedent applicable to part-time faculty in the future, or to any other employee group at any time.
